Judge Timothy Kelly
District of Columbia U.S. District Court
Timothy James Kelly was born in Glen Cove, New York. He earned his undergraduate degree from Duke University and received his Juris Doctor from Georgetown Law. He clerked at the U.S. District Court for the Eastern District of Pennsylvania.
Kelly spent a decade as a federal prosecutor, serving first as an Assistant United States Attorney in the District of Columbia and then as a trial attorney in the Public Integrity Section of the Department of Justice’s Criminal Division. He went into private practice as a civil litigator.
Kelly was nominated by President Donald Trump to serve as a United States District Judge of the U.S. District Court for the District of Columbia. His nomination was confirmed by the Senate, and he received his commission in September 2017.
Kelly is married and has two children.

D.C. Circuit U.S. District Court Judge Timothy Kelly determined that Attorney General Pamela Bondi deprived former death row inmates of their Fifth Amendment right to due process by initiating their transfers to a supermax prison in Colorado. The inmates’ death sentences had been commuted by President Joe Biden as his term concluded.
Temporarily blocking the transfer, Judge Kelly wrote, “It is likely their redesignations were determined before their process even began, and that — despite their hearings and appeals — they had no meaningful opportunity to challenge them.”
Judge Kelly added, “The Constitution requires that whenever the government seeks to deprive a person of a liberty or property interest that the Due Process Clause protects – whether that person is a notorious prisoner or a law-abiding citizen – the process it provides cannot be a sham.”
